They could use Clause 4.2.1 and argue that without a rating plate there's no way to know if the appliance is approved.

QuoteClause 4.2.1 - An appliance, accessory, component, equipment, or material used in an installation shall be of a type and rating approved for the specific purpose for which it is employed.

Hrm. Interesting.

If one was to pull the rating plate off for some dumb reason. How would you solve this problem? Without changing the entire tank I mean. I doubt the rating plates are for sale anywhere.

It wouldn't surprise me if the water heater had to be returned to the manufacturer to be re-certified, but you may want to contact them to see if they could provide a new rating plate.  I'm just not sure how they would know what the model and serial numbers are.

The client will likely be buying a new water heater.

Tagged 4.1.3 customer just went with a new tank instead of arguing about it

Sounds like a found tank. Or one that was supposed to be returned to direct energy. They would remove rating plates before disposal/recycling..
